Agreement to these terms

By using ecomcreatorz.com or purchasing any service from Ecom Creatorz ("we," "us," "our"), you agree to these Terms & Conditions. If you have signed a separate proposal or service agreement with us, that agreement controls wherever it conflicts with these Terms.

We are an independent business

Nothing in these Terms or in our services creates any relationship between you and any platform on our behalf, and we cannot make any commitment on a platform's behalf. See our Disclaimer for more.

Our services

We provide done-for-you ecommerce and content services, such as product research, store setup, listing creation, advertising management, order and customer support, and YouTube channel production. The exact scope, deliverables and timeline of your engagement are confirmed with you before work begins.

All project requirements are discussed with you before the project starts. Any disagreement about the level of service will be resolved based on the requirements agreed at the start, these Terms and reasonable business practices.

Your accounts and responsibilities

• Seller accounts, shops, stores and channels are opened in your name and belong to you.
• You are responsible for giving us accurate information, and for complying with each platform's terms of service in your role as the account owner.
• You are responsible for third-party costs, including inventory, advertising spend, platform subscriptions and fees, shipping, software and taxes, unless we agree otherwise in writing.
• You choose what access to give us, and you can revoke it at any time. Revoking access may stop us from delivering the services.

Platform rules and risk

Platforms can change their policies, fees, algorithms and requirements at any time, and may approve, restrict, suspend or close accounts at their own discretion. We follow each platform's published policies, but we do not control platform decisions and cannot guarantee any outcome.

We are not liable for losses caused by platform actions, including account suspensions, listing removals, fund holds, policy or fee changes, or platform outages.

No guarantee of results

Online businesses involve risk. We do not guarantee any specific sales, profit, income, rankings, views, subscribers or return on investment. Results shown on our website are from individual clients and are not typical.

Payment

• 100% advance payment is required for the services listed on our website, unless we agree to a different schedule in writing.
• You are responsible for any transaction fees and applicable taxes.
• Third-party costs such as inventory, ad spend and platform fees are separate from our service fees.

Revisions

For creative deliverables such as listings, store designs, scripts, videos and thumbnails, we will make revisions at no extra cost when you request them within 14 days of delivery, as long as the requests stay within the original scope and concept. Revisions are usually completed within 1–2 business days, depending on the size of the request.

Refund policy

Please read this policy carefully so you understand when refunds are and aren't available.

• Before work begins: you are entitled to a 100% refund of our service fee.
• After work begins: refunds are reviewed case by case and are not unconditional.
• Refunds never include third-party costs that have already been spent, such as inventory, ad spend or platform fees.

Refunds are not available if:

• You chose a special or custom package.
• You requested revisions beyond the original scope or concept.
• You were unresponsive for more than 2 weeks without notice.
• The project was placed on hold at your request.
• These Terms or our policies were violated.
• Information we needed from you to complete the work was not provided.
• Your business is closing, changing its name or changing direction.
• A platform account, shop or channel related to the service is suspended, restricted, placed on hold or closed, whether temporarily or permanently.
• The reason is unrelated to the service we provided, such as a change of mind or a disagreement with a business partner.
• You have already accepted multiple sets of revisions.

How to request a refund

2. We will first try to resolve the problem under our revision policy. If we can't, our team will review your refund request and confirm the decision in writing.

SMS messaging terms

These terms apply to the Ecom Creatorz text messaging program.

• How you join: you opt in by checking the consent box on one of our website forms and submitting it. The box is optional and never pre-checked.
• Messages you may receive: replies to your inquiry, consultation scheduling and appointment reminders, service updates, and marketing offers about our services.
• Message frequency: varies.
• Cost: message and data rates may apply. Contact your wireless carrier for details about your plan.
• Opting out: reply STOP at any time. You will receive one final message confirming that you have been unsubscribed. To opt back in, reply START.
• Help: reply HELP, email info@ecomcreatorz.com or call +1 (917) 341-6981.
• Carriers: mobile carriers are not liable for delayed or undelivered messages.
• No purchase required: consent to receive text messages is not a condition of any purchase.

Phone call consent

If you check the consent box on one of our website forms, you also agree that Ecom Creatorz may call you at the phone number you provided about your inquiry and our services, including marketing calls that may use automated technology or prerecorded messages. Consent is not a condition of any purchase. You can withdraw it at any time by telling us during a call, emailing info@ecomcreatorz.com or calling +1 (917) 341-6981.

Ownership of work

Once your payment is complete, you own the copyright to the content we create and deliver for you, such as listing copy, designs, scripts and videos, and you may use it as you see fit. Ecom Creatorz keeps ownership of our website, brand, internal tools, templates and processes. Third-party names and logos remain the property of their owners.

Confidentiality

We treat your account credentials, business data and financial information as confidential. We use them only to deliver our services and share them only with team members and service providers who need them for that purpose.

Use of this website

The information on this website describes our services. It is not advice, certification, guarantee or warranty of any kind. You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation or copying its content for commercial use without permission.

Limitation of liability

To the fullest extent permitted by law, Ecom Creatorz and its owners, employees and contractors are not liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from your use of the Site or our services. Our total liability for any claim is limited to the fees you paid us for the specific service that gave rise to the claim.

We are not liable for any loss or damage arising from an inadvertent error in the information on this website.

Indemnification

You agree to defend, indemnify and hold harmless the company and its affiliates, officers, agents and employees from any claims, liabilities, damages, losses and expenses arising from (i) your use of the Site or services, (ii) your violation of these Terms, or (iii) your violation of any third-party right, including intellectual property, publicity, confidentiality, property or privacy rights.

Independent relationship

These Terms and your use of our services do not create a joint venture, partnership, employment or agency relationship between you and Ecom Creatorz. We act as an independent service provider.

Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in New York, unless your service agreement says otherwise.

Changes to these terms

We may update these Terms from time to time. The "last updated" date at the top of this page shows when they last changed. Continuing to use the Site or our services after an update means you accept the revised Terms.
